Eligibility:
The Contest is open to Cumberland Valley Electric members residing within the United States and in good financial standing with Cumberland Valley Electric. Only residential members will be eligible. Employees, officers, directors, representatives, and immediate family members of Cumberland Valley Electric and their respective parent companies, affiliates, and subsidiaries are not eligible to participate in this Contest.
Entry:
Members of Cumberland Valley Electric will be entered into the drawing by being a member that has elected to not receive a paper bill during the promotion period of April 1, 2023, to June 30, 2023. The contest will begin on April 1, 2023, and runs through June 30, 2023. At the end of each month during the contest period, one winner will be selected from the pool of eligible participants. Participants are only eligible to win once and those with any entries after the contest end date are ineligible for participation. Entries will be disqualified, at the sole discretion of Cumberland Valley Electric, if any attempts are made to disrupt the Contest or circumvent the terms and conditions of these Official Rules. If the above occurs, Cumberland Valley Electric reserves the right to remedy any such action, disruption, or circumvention in a manner, determined solely by Cumberland Valley Electric, which is fair and equitable to Contest participants. The Contest Numbers and Prizes are not transferable or assignable and they are not redeemable for cash. All winners are responsible for the payment of any and all taxes and/or licenses and/or other related Local, State, and Federal fees that may apply to such winnings. Taxes on prizes are solely the responsibility of the winners. Cumberland Valley Electric reserves the right to replace the advertised prize(s) with a prize of equal or greater value if the advertised prize(s) is/are no longer available. Cumberland Valley Electric will not be responsible for replacing any lost or stolen elements of any prize package. All prizes will be awarded. Odds of winning depend on the number of eligible entries received, according to the eligibility requirements in this Contest.
Winners will be selected by a random drawing on May 1st 2023, June 1st, 2023, and July 3rd 2023 from among all eligible entries received. Random drawings will be held under the supervision of Cumberland Valley Electric. All decisions by Cumberland Valley Electric are final and binding. Winners will be notified via phone call and/or email. Each winner may be required to provide Cumberland Valley Electric with proof that he or she is the authorized account holder of the electric account associated with the winning entry. If a selected winner cannot be contacted, is ineligible, fails to claim a prize within one week of being notified of winning, or fails to return a completed and executed affidavit and release as required, an alternate winner may be selected. Each Entrant may only win once for each electric account eligible. Except where prohibited by law, acceptance of any prize constitutes permission for Cumberland Valley Electric to use the winner's names, photographs, likenesses, voices, addresses (only city and state), and testimonials, in print, broadcast, or news media, in perpetuity, in any manner they deem appropriate in connection with promoting this or any other contest and/or promotion sponsored by them without further compensation.
Conditions:
By entering, participants agree to be bound by these complete Official Rules and the decisions of Cumberland Valley Electric, which shall be final. All federal, state, and local laws apply. Cumberland Valley Electric and its employees, officers, directors, shareholders, agents, and representatives and their parent companies, affiliates, subsidiaries, and advertising, promotion and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) failed, returned, or misdirected notifications based on inaccurate information provided by the winner; or (iii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties resulting from participation in this Contest or otherwise; (iv) errors in transmission; (v) any condition caused by events beyond the control of Cumberland Valley Electric that may cause the Contest to be disrupted or corrupted; (vi) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the Contest; or (vi) any printing or typographical errors in any materials associated with the Contest.
The Contest shall be construed and governed by, and any and all actions or claims in any way related to this Contest are subject to, the federal laws and regulations of the United States, the state laws and regulations of the State of Kentucky, and local laws and regulations of the County of Knox, Kentucky. Any and all actions or claims in any way related to this Contest shall be filed in the courts of the State of Kentucky, County of Knox. By Providing an Entry to this Contest, you submit to the jurisdiction of the courts of the State of Kentucky in the United States for any and all actions or claims in any way related to this Contest, and expressly agree that such actions or claims are subject to the federal laws and regulations of the United States, the state laws and regulations of the State of Kentucky, and local laws and regulations of the County of Knox, Kentucky. Cumberland Valley Electric may prohibit you from participating in the Contest, if at the sole discretion of Cumberland Valley Electric, you repeatedly show a disregard for the Contest Official Rules, or act (1) in an unsportsmanlike manner; (2) with an intent to annoy, abuse, threaten, or harass any other participant or a representative of Cumberland Valley Electric; or (3) in any other disruptive manner.
Releases:
By participating, entrants agree that Cumberland Valley Electric, those involved in the development, production, implementation, and distribution of this promotion and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Contest, including entry and participation in this Contest and acceptance, possession, use or misuse of the prizes. All entrants further agree that in the event of any third-party claims, damages, losses, or injuries, arising from or relating to a participant's entry or participation in this Contest, they will indemnify Cumberland Valley Electric from any and all such claims, including the attorneys' fees related thereto. Any person attempting to defraud or in any way tamper with this Contest will be ineligible for prizes and may be prosecuted to the full extent of the law. Cumberland Valley Electric reserves the right, in their sole discretion, to cancel or suspend this Contest should viruses, bugs, or other causes beyond their control corrupt the administration, security, or proper play of the Contest. Cumberland Valley Electric further reserves the right to modify the rules of the Contest in any way or at any time, as long as reasonable notice is given.
